Deception in Advertising: “Big” Personal Injury Firms

You will see testimonials from these firms or people who are saying they got $100,000, but what people don’t realize is that there is a disclaimer at the bottom which says that results can vary – and they vary a great deal.

It is a fact that the average soft tissue injury verdict in the state of Ohio is $7,500, but the people that got those verdicts did not get them for free. Average cost of trial is anywhere from $2,000 – $4,000, and the client does not get that money back. The $7,500 really turns into something more like $3,500, not to mention all the aggravation and time consumed by the lawsuit, discovery (depositions and interrogatories), and trial.

No responsible attorney should tell a client what their case is worth before they have finished completing their treatment. There’s a huge difference between soft tissue injuries which are subjective in nature. This means that the only proof of the injury are the complaints voiced by the client or patient versus an objective injury such as a torn muscle, a broken bone, or necessary surgery. These cases are in a completely different class. Sometimes a soft tissue injury becomes a more serious case when the complaints are ongoing and a subsequent MRI reveals another cause (ex. a bulging disc). These become completely different cases because they require surgical intervention.
